
EMPLOYMENT ELIGIBILITY VERIFICATION
Signed into law November 6, 1986, the Immigration Reform and Control Act of 1986, requires employers to examine documents on all new employees to verify identity and work eligibility. Students who work on-campus are classified as employees.
Employment Eligibility Verification for student employees are the responsibility of work supervisors. You will be required as a Student Worker Supervisor to certify each student's I-9 form (see appendix K). By law, verification of documents must be completed within the first three days of employment. If students do not have a required document, then they have only 21 days to obtain the proper documents. Students will be terminated for failure to turn in the proper documents.
The University’s International Tax Manager will be responsible for verifying employment eligibility for international students. A separate certification is required for these students, and therefore, must be verified through our offices with the proper documentation in order to verify their eligibility to work. Please refer all international students to the Payroll Office in University Service Center.
For most working students, a Driver's License or University Identification Card will verify Identity (has photograph), and the original Social Security Card or Birth Certificate (original or certified copy), will verify Work Eligibility. These items are in Lists B and C on the I-9 form (see appendix K) and an item must be checked in each column. Furthermore, note that List A establishes both identity and employment eligibility. So, if a student has a passport (expired or unexpired) or other documents in List A, you will only need to check one item. All examined documents must have the document Identification number and Expiration Date (if any) listed on the I-9.
The verification process began on July 1, 1987. Once the verification process has been completed and there has been a break in service, the I-9 form needs to be updated in Section 3. It is a good policy to keep copies of all I-9 forms on file so you will have access to them at any time.
